Terms and Conditions
Acknowledgment of Human Food Waste By-Product Source and Handling. The Farmer acknowledges that the human food waste by-products provided have been sourced from restaurants and other food service establishments.
While Dyrt requires its partners to separate out specified fruits and vegetables to minimize contamination, Dyrt cannot guarantee the absence of foreign objects or non-feed-safe materials such as plastics or glass.
Farmer Responsibilities. The Farmer agrees to inspect the provided food waste upon pickup and assumes full responsibility for ensuring its safety and suitability for use as animal feed.
The Farmer affirms compliance with all applicable federal, state, and local regulations governing the use of food waste in animal feed, including the California Commercial Feed Law (California Food and Agricultural Code, Division 7, Chapter 6).
Permissible Use and Restrictions. The Farmer acknowledges that if provided, materials labeled as “slop” must not be fed to cattle or other ruminant animals restricted under Title 21, Code of Federal Regulations, Part 589.2000.
Liability Waiver. The Farmer assumes all risks associated with the collection, transportation, storage, and use of the food waste.
Dyrt shall not be held liable for any damages, losses, or claims arising from the use of the food waste, including harm to livestock, contamination, or regulatory penalties.
Indemnification. The Farmer agrees to indemnify, defend, and hold harmless Dyrt, its officers, employees, and affiliates from any claims, damages, or liabilities, including attorney fees, arising from the Farmer’s use of the food waste.
Warehouse Safety and Liability for Loading Operations. The Farmer agrees to comply with all warehouse safety protocols while on Dyrt premises, including but not limited to:
Adhering to designated pickup areas.
Wearing appropriate personal protective equipment (PPE) as required for safe handling and transport. The Farmer is solely responsible for obtaining, maintaining, and properly using the necessary PPE.
Following all safety instructions provided by warehouse personnel.
DYRT AND ITS EMPLOYEES, INCLUDING WAREHOUSE WORKERS, SHALL NOT BE HELD LIABLE FOR ANY DAMAGE TO THE FARMER’S VEHICLE OR ANY THIRD-PARTY VEHICLE, PERSONAL INJURY, OR PROPERTY DAMAGE RESULTING FROM THE LOADING OF FOOD WASTE ONTO THE FARMER’S TRANSPORT.
The Farmer assumes full responsibility for ensuring their vehicle is properly positioned and suitable for the safe transport of loaded food waste.
Recordkeeping and Location. This Agreement will be retained at the warehouse office of Dyrt for compliance and recordkeeping purposes.
Miscellaneous. This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral.
Any amendments to this Agreement must be made in writing and signed by both parties.

Fresh Greens by the Tote
Pickup at 2550 e 27th street. Must pickup with truck or flatbed trailer capable of carrying specified number of IBC totes. Pickups can occur any day of the week before 2pm. We have a forklift on-site to help load.
